Draft pending legal review. These terms cover use of the Queensland Fish Market app and website. They do not yet cover bidding, credit or settlement, which will need separate trading terms drafted with a solicitor before online bidding opens. Nothing here is legal advice.

1. What these terms cover

These terms apply to the Queensland Fish Market buyer app and this website. Separate trading terms govern buying at auction, and you will be asked to accept those specifically when you register a business to buy.

2. Market information is indicative

Prices, weights and auction results published in the app and on this site describe what has already cleared at auction. They are historical information about a market, published in good faith.

Prices exclude the trades of suppliers related to Queensland Fish Market, so that published figures reflect arm's-length price discovery. Where a species traded too thinly on a given day to publish meaningfully, it is omitted rather than shown.

3. Your account

You may read market prices and auction results without an account. An account is needed to register a business, see your own purchases, and later to bid.

You are responsible for what happens under your account. Tell us promptly if you believe someone else has access to it. You must not share sign-in credentials, and you must not let another person act under your identity — on the auction floor, an action taken under your account is treated as yours.

4. Registering a business to buy

Registering is an application, not an entitlement. Queensland Fish Market decides who is approved to buy, and may decline, suspend or withdraw an approval at its discretion, including on credit grounds.

You must give accurate business information, including a valid ABN, and keep it current. You must be authorised to bind the business you register.

5. Acceptable use

You must not:

Reading the market, quoting a price to a customer, or using the data to run your own business is exactly what it is published for. This clause is about resale and re-identification, not ordinary use.

6. Availability

We aim to keep the service available but do not guarantee it. It may be unavailable for maintenance, or because something has broken. Market data depends on the market's own records being up to date.

7. Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded.

Subject to that, Queensland Fish Market is not liable for loss arising from reliance on published market information, or from the service being unavailable. Commercial decisions you make on the basis of published prices are your own.

8. Changes

We may update these terms. The version and date are shown at the top, and we keep a record of which version you accepted. Where a change materially affects you, we will tell you rather than relying on you to re-read this page.

9. Governing law

These terms are governed by the laws of Queensland, Australia.
